Terms of use

1. Agreement

By downloading, installing, or using CloudLase ("the Software"), you agree to these Terms of Use. If you do not agree, do not use the Software. CloudLase is developed and operated by CloudLase ("we", "us", "our"), based in Australia.

2. License

We grant you a non-exclusive, non-transferable license to use the Software subject to these terms and your selected pricing tier. The licence is revocable only as described in section 11 (Termination), that is, for material breach. Lifetime licences (including Early Adopter) are not revocable for ordinary use, end-of-business, retirement of the Software, or any future change to our pricing or licensing model.

  • Free tier: You may import and play ILDA files, use the built-in simulator, connect one hardware DAC, and access basic projector calibration settings.
  • Paid tiers: You may use all features of the Software, including the show designer, effects engine, performance mode, audio sync, live canvas, and multi-device output, as described on our website at the time of purchase.

Licenses are per-user. You may install the Software on multiple personal machines but may not share, resell, sublicense, or distribute license keys.

3. Beta Software

CloudLase is currently in beta. The Software is provided on an "as is" basis. Features may change, break, or be removed between updates. We make no guarantees of stability, uptime, or fitness for any particular purpose during the beta period.

3.1 Early Adopter Lifetime Licences

Early Adopter beta licences are lifetime licences. For the avoidance of doubt, an Early Adopter licence:

  • Is permanent for the life of the Software, with no expiry and no recurring fees.
  • Includes all future releases, updates, and Pro features at no additional cost, regardless of any future pricing changes or new tiers we introduce.
  • Will not be downgraded or converted to a subscription. We will not retroactively move Early Adopter users onto a subscription, time-limited, or pay-per-feature model.
  • Permits commercial use, including paid shows, festivals, council and corporate bookings, private events, and other revenue-generating performances.
  • Leaves all user-created content with you: shows, designs, ILDA exports, and workspace files are yours; we claim no ownership over them (see section 10).
  • Activates once and runs offline thereafter. On activation, the licence key is verified once against our licensing service. After activation, ongoing validation is performed locally via an Ed25519 signature embedded in the key file. CloudLase does not call our licensing server during normal use, and the Software remains fully functional offline. There is no periodic re-validation requirement for Early Adopter licences.
  • Is not tied to a single machine. You may install and activate CloudLase on multiple personal machines (e.g. a main show computer and a backup), subject to the device limit on your licence and section 9 (no sharing/redistribution).
  • Allows installer archiving. You may keep copies of the installers you have downloaded for future reinstallation. Re-installing an archived build with your existing key will continue to work without server contact.
  • Is revocable only for material breach: fraud, payment chargeback, redistribution of the Software or licence keys, or deliberate circumvention of licence validation. It will not be revoked for ordinary use, for the operator going out of business, for the Software being retired, or for any change in our licensing provider or pricing model.

4. Educational Licences

Educational licences are granted free of charge to verified students, teachers, researchers, and accredited educational institutions for non-commercial educational use only. Eligibility, application, and verification are described at cloudlase.studio/education.

Permitted use under an educational licence includes:

  • Coursework, assessments, and personal learning
  • Classroom and lecture demonstrations
  • Postgraduate and academic research
  • Free, non-ticketed campus events organised by the institution
  • Open-day and recruitment showcases run by the institution

Prohibited use under an educational licence includes (without limitation):

  • Any paid performance, paid commission, or ticketed event
  • Any sponsored, corporate, or commercial event, including those held on campus
  • Commercial venue installations
  • Paid client work, freelance gigs, or work performed under contract, even when the operator is a student
  • Any use that generates revenue, regardless of the nature of the user or institution

Educational licences expire 12 months from issue. To continue using the Software, you must re-apply and re-verify your eligibility before expiry. Educational licences are limited to two installations per user.

We may suspend or revoke an educational licence at any time, with or without notice, including retroactively, where we have reasonable grounds to believe these terms have been breached. Where misuse is established, you agree that we may pursue you for the full commercial Pro licence fee for the period during which the Software was used outside the scope of the educational licence, in addition to any other remedies available to us.

We may also discontinue the educational programme entirely at any time. Existing educational licences will continue until their expiry date unless suspended or revoked under the paragraph above.

5. Payments & Refunds

Payments are processed securely via Stripe. All prices are listed in Australian Dollars (AUD) and include GST where applicable.

Due to the digital nature of the Software, we offer refunds at our discretion within 14 days of purchase if you have not activated a hardware device under your license. Once a device has been activated, the license is considered used and is not eligible for a refund.

6. Privacy & Data

CloudLase runs entirely on your local machine. We do not collect, transmit, or store your designs, audio files, workspace data, or laser output. Your creative work stays on your computer.

We collect the following limited data:

  • License validation: On activation, your license key is verified once against our licensing service (Keygen.sh) and bound to your machine. This transmits your licence key and a device fingerprint (hardware identifier). After activation, validation behaviour depends on your tier:
    • Lifetime tiers (including Early Adopter): no periodic online re-validation. The licence is verified locally on launch using an Ed25519 signature embedded in the key file. CloudLase does not contact our licensing server during normal use and remains fully functional offline.
    • Subscription tiers: a background re-validation runs at most once per cooldown period (currently 7 days) to confirm renewal status. The Software continues to function between checks.
    You can manually trigger a re-validation at any time from the licence settings.
  • Crash reports: If enabled, anonymous error reports are sent to our error tracking service (Sentry) to help us fix bugs. These contain stack traces and system information but no personal data or workspace content. Crash reporting works offline: reports are cached locally and sent when internet is available. You can use the Software fully offline.
  • Email: If you purchase a license or contact us, we store your email address for license delivery and support communication.

We do not sell or share your data with third parties. We do not use analytics or tracking on the desktop application.

7. Laser Safety

IMPORTANT, READ CAREFULLY

CloudLase is a tool for controlling laser projection hardware. Laser projectors emit concentrated light that can cause permanent eye injury, skin burns, and fire if used incorrectly.

By using CloudLase with laser hardware, you acknowledge and agree to the following:

  • You are solely responsible for the safe operation of your laser equipment. CloudLase is a control tool; it does not replace proper training, safety equipment, or regulatory compliance.
  • Never expose eyes to direct or reflected laser beams. Even low-power lasers can cause permanent vision damage. Always use appropriate laser safety eyewear rated for your laser's wavelength and power.
  • Audience scanning (directing laser beams into areas where people are present) is subject to strict regulations in most jurisdictions and requires professional variance approvals. It is your responsibility to understand and comply with all applicable laws and safety standards in your jurisdiction.
  • Keep laser apertures above head height and ensure adequate exclusion zones. Never operate laser projectors at eye level.
  • Know your hardware. Understand the power output, divergence, and classification of your laser projector. Operate within the rated specifications of your equipment.
  • Use a hardware safety interlock (e-stop / kill switch) that can immediately cut power to the laser independent of any software.
  • Software safety features are provided as a convenience and must not be relied upon as the sole safety mechanism. CloudLase includes scan safety settings (minimum shape size to prevent hot-dot burns) and configurable scan zones, but these are software-level protections and cannot substitute for proper hardware safety interlocks, physical barriers, and trained operators.
  • Software bugs can cause hazardous output. As beta software, CloudLase may contain bugs that result in unexpected laser output including static beams, maximum-power points, or loss of blanking control. Always have a hardware e-stop within immediate reach.
  • Comply with all applicable regulations including but not limited to IEC 60825, FDA/CDRH 21 CFR 1040, and your local workplace health and safety laws.

8. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any injury, damage, or loss arising from your use of the Software or any laser hardware controlled by it. This includes but is not limited to:

  • Eye injury or vision damage from laser exposure
  • Property damage or fire caused by laser equipment
  • Damage to laser hardware, DACs, or galvo scanners
  • Loss of data, revenue, or business opportunity
  • Regulatory fines or legal action resulting from non-compliant laser operation

The Software is provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Our total liability to you for any claim arising from these terms shall not exceed the amount you paid for your license.

9. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or disassemble the Software, except to the extent such activity is expressly permitted by applicable law (including, in Australia, sections 47B–47F of the Copyright Act 1968 (Cth)) and cannot lawfully be excluded by these terms
  • Redistribute, sublicense, or resell the Software or license keys
  • Remove or circumvent any license validation or copy protection
  • Use the Software to intentionally cause harm or damage
  • Use the Software for commercial purposes under an educational licence (see section 4)
  • Misrepresent your use of the Software (e.g., claiming compliance with safety standards when not compliant, or claiming educational eligibility you do not have)

10. Intellectual Property

The Software, its source code, design, and documentation are the intellectual property of CloudLase. Your license grants you the right to use the Software, not ownership of it.

Content you create with CloudLase (laser shows, ILDA files, workspaces) is yours. We claim no ownership or rights over your creative work.

11. Termination

We may suspend or terminate your licence if you materially breach these terms, including fraud, payment chargebacks, redistribution of the Software or licence keys, or attempts to circumvent licence validation. Lifetime licences (including Early Adopter) will not be terminated for ordinary use, for the operator going out of business, for retirement of the Software, or for any change in our pricing or licensing provider.

Upon termination, you must stop using the Software and delete all copies. Sections 7 (Laser Safety), 8 (Limitation of Liability), and 10 (Intellectual Property) survive termination.

12. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email to registered license holders. Continued use of the Software after changes constitutes acceptance of the updated terms.

13. Governing Law

These terms are governed by the laws of Australia. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Australia.
